    The House Education and Workforce Committee voted this week to advance the Title IX Clarification Act of 2026 (H.R. 8781), a Republican-led bill that would define “sex” under Title IX as an individual’s biologically determined sex, either male or female. The bill now heads to the full House.

    What The Bill Does

    The legislation, introduced by Rep. Jodey Arrington (R-Texas) with 22 cosponsors, writes gamete-based definitions directly into Title IX. “Female” would mean an individual whose reproductive system at some point produces ova, and “male” would mean an individual whose reproductive system at some point produces sperm.

    The changes would take effect upon enactment and apply to any education program receiving federal money from that date forward.

    Democrats on the committee opposed the measure. Ranking Member Rep. Bobby Scott (D-Va.) said the bill would “narrow the scope of existing civil rights law by writing transgender students out of Title IX’s protections.”

    Impact On K-12 Schools

    Title IX compliance is a condition of federal funding, and public school districts rely on billions in federal dollars annually – money that has already been subject to funding pauses under the Trump administration.

    If enacted, the bill would give schools a statutory basis for restricting sports teams, bathrooms, and locker rooms by biological sex. Education policy experts expect the Department of Education to apply the same reasoning to pronoun and facilities disputes.

    Enforcement of these rules is also shifting. The administration has moved civil rights oversight from the Education Department to the Justice Department as part of its broader effort to dismantle the agency, meaning any new definition would be enforced by DOJ attorneys rather than traditional ED civil rights staff.

    Impact On Higher Education

    Colleges face higher financial stakes. Because Title IX applies to any institution accepting federal student aid, noncompliance can put Pell Grants and federal student loans at risk. 

    A biological definition of sex would directly shape how colleges structure men’s and women’s athletics, athletic scholarships, and campus housing and facilities policies.

    The Supreme Court’s June decision already permits at least 27 states to keep bans on transgender athletes in women’s college sports. A federal statute would extend that framework nationwide, overriding conflicting state policies at public and private institutions alike.

    What’s Next

    The bill was one of multiple advanced this week, alongside proposals to let parents opt children out of school surveys, fund AI training for students and teachers, and revive the Presidential Fitness Test. 

    H.R. 8781 still needs a full House vote and 60 votes in the Senate, which may be a steep climb. It arrives as House Republicans separately push breaking apart the Education Department.
